A representation of your lighting package and our liability agreement are below. By accepting the proposal provided, you acknowledge you have read and accepted the Waiver and Release of Liability.

Waiver and Release of Liability

  1. RELEASE OF LIABILITY
    To the maximum extent allowed by law, I, the undersigned agree to waive and release any and all claims, suits or related causes of action against LET THERE BE LIGHT, LLC, its owners, officers, employees, or agents for negligence, injury, loss, death, costs or other damages to me, my heirs or assigns, related to the installation, maintenance, design removal etc. of holiday/Christmas lighting. Other provisions:

INDEMNIFICATION – I agree and I will indemnify, defend and hold LET THERE BE LIGHT, LLC harmless, to the extent allowed by law, from negligence, injury, loss, death costs or other damages to me, my heirs or assigns, or third parties for claims, suits or related causes of action asserted against LET THERE BE LIGHT, LLC arising from any acts while engaged in the lighting services referenced above.
  3. APPLICATION – I AGREE THIS WAIVER AND RELEASE OF LIABILITY shall apply throughout the time and period lighting services and installation are provided up and until their removal.
  4. REASONABLE CARE – I understand that I have a duty to exercise reasonable care for my own safety and on the behalf of others and I agree to do so.
  5. HOLD HARMLESS – I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS LET THERE BE LIGHT, LLC and their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
  6. APPLICABLE LAW – This Release is governed and shall be construed in accordance with the laws of the State of North Carolina, without any reference to its choice of law rules. I agree that any dispute arising from this Release or in any way associated with LET THERE BE LIGHT, LLC or its agents, assigns, franchisees, etc. shall be brought only in the Superior Court of Onslow County, North Carolina, or in the District Court of Onslow County, North Carolina, and I agree to the jurisdiction and venue of those courts for any such dispute. In any litigation in which the validity or enforceability of this Release is contested, I agree that the prevailing party will be entitled to receive all attorney’s fees and costs from the party contesting the validity of this Release.

    BY ACCEPTING THIS PROPOSAL I AGREE I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE START OF SERVICES RENDERED, FOREVER INTO THE FUTURE.

Cancellation Policy


At Let There Be Light, we understand that circumstances may arise requiring the cancellation of scheduled services. To ensure transparency and fairness, our cancellation policy is as follows:

Cancellation Before Services Rendered:
If no services have been performed—including installation, maintenance, removal, or storage—the customer may be eligible for a refund. Refund eligibility and amount will be determined at our discretion.

Cancellation After Services Rendered:
If any services have been provided, the customer will not be entitled to a full refund. The refund amount, if any, will be calculated based on the services already rendered and the associated costs incurred by Let There Be Light.

Notification:
Cancellations must be communicated to us in writing via email at info@lettherebelight.com. Please provide as much notice as possible to allow us to adjust our schedules accordingly.

Exceptions:
We understand that emergencies and unforeseen circumstances can occur. In such cases, please contact us promptly to discuss potential exceptions to this policy.

Right to Use/License to Enter:
Customer hereby grants Let There Be Light, its employees, subcontractors, agents etc. the right and permission to enter and use the Customer’s property including their driveways, walkways, roofs, windows, trees, bushes or any other structure for the purpose of performing the agreed upon work and services. Such access shall be permitted during normal working hours, which access shall not be unreasonably withheld unless agreed upon in writing. In addition, Customer hereby grants Let There Be Light access and permission to enter the Customer’s property during reasonable working hours to retrieve any and all lighting material upon conclusion of the season.

Breach of Agreement:
If Customer unreasonably refuses, or fails to grant Let There Be Light access to the property as required under this Agreement, Customer shall be liable for any resulting costs, losses or damages incurred by Let There Be Light. Such damages include, but are not limited to, costs of procuring replacement materials and equipment, rescheduling fees, labor charges, attorney fees and any other consequential damages arising from Customer’s refusal.

Seasonal Pricing Package:
Customer acknowledges that each payment package is a flat rate, bundled seasonal service that covers installation, seasonal maintenance, removal and storage. To that end, Customer further acknowledges that there are no discounted rates in the event Customer elects to forego any of the above services provided as part of the seasonal payment package and bundled service.

Ownership of Lighting Materials:
Customer acknowledges that any and all lighting material provided by Let There Be Light remain the sole and exclusive property of Let There Be Light. However, once Customer’s invoice is paid in full with no monetary obligations outstanding, and after the season’s completion, ownership of the lighting material is transferred to Customer. If Customer fails to make full payment in violation of this Agreement, Let There Be Light reserves the right to remove, reclaim or recycle the lighting materials in accordance with their policies.

Waiver:
As part of the lighting storage associated with the bundled seasonal service, Customer acknowledges that lighting material will be stored on-site at a Let There Be Light designated location. As part of the agreement between Customer and Let There Be Light as provided under this section, Customer agrees, and waives any future legal recourse, if any, that in the event Customer elects to not use the services of Let There Be Light for two (2) consecutive years, Customer’s lighting will be disposed accordingly at the sole discretion of Let There Be Light.
